These Terms of Service ("Terms") are a binding agreement between you and Facefinder, a service operated by Emil Arnold ("Facefinder", "we", "us"), governing your access to and use of the Facefinder mobile application and related services (the "App"). By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the App.
You must be 18 years of age or older to use Facefinder. By using the App you represent and warrant that you are at least 18, have the legal capacity to enter into these Terms, and will comply with them and all applicable laws.
Facefinder is available in many countries, including the European Economic Area. Wherever you use the App, you are responsible for complying with the laws that apply to you. Where applicable, we process personal data in accordance with applicable data-protection laws, including the EU/UK General Data Protection Regulation (GDPR); see our Privacy Policy.
Facefinder is a search interface. You submit a photo and a third-party facial-similarity search provider returns possible visual matches from publicly available sources. Facefinder does not build, index, scrape, or maintain any database or profile of individuals, and does not verify the identity of anyone appearing in results.
How it works: (1) you select a photo; (2) the photo is sent to a third-party facial-similarity API (FaceCheck.ID, operated by Tech Solutions, Belize); (3) the provider performs a visual-similarity search of publicly available sources and returns results; (4) results are displayed in the App. Facefinder does not store your photo; the provider processes it and deletes it within 24 hours under its own policy.
You agree not to: use the App for any unlawful purpose; scrape, harvest, or systematically collect data or build any database from the App; interfere with or disrupt the App or its security features; reverse engineer, decompile, or copy the App's software except as permitted by law; impersonate any person; or use any automated means (bots, scripts, scrapers) to access the App.
You specifically agree that you will NOT use the facial-search features to:
Violation may result in immediate termination of your access without refund, and we may report unlawful conduct to the authorities.
Facefinder is not a consumer reporting agency and the App is not a "consumer report" under the U.S. Fair Credit Reporting Act (FCRA) or similar laws. You will not use the App or its results for any purpose covered by the FCRA or for employment, housing, tenancy, credit, or insurance decisions.
Facial-similarity search is probabilistic. Many unrelated people look alike. Results may be inaccurate, incomplete, outdated, or irrelevant, and the presence of a photo in results does not confirm a person's identity. You must never rely solely on a face search, and you should cross-reference multiple independent sources before forming any opinion about a person. Results come from publicly available sources surfaced by a third party — not from Facefinder. Results are provided "AS-IS" without warranty of accuracy, completeness, reliability, or fitness for any purpose.
The App, its design, software, text, graphics, and logos (the "Content" and "Marks") are owned by or licensed to Facefinder and are protected by intellectual-property laws. You receive a limited, revocable, non-exclusive, non-transferable license to use the App for your personal, non-commercial use. All rights not expressly granted are reserved.
If you access the App via Apple's App Store, the license granted is limited to use on an Apple-branded device you own or control, in accordance with the App Store Terms of Service. You and we acknowledge that these Terms are between you and Facefinder only, not Apple; Apple is not responsible for the App or its content; and Apple and its subsidiaries are third-party beneficiaries with the right to enforce these Terms against you. You represent that you are not located in an embargoed country and are not on any U.S. prohibited-party list.
Facefinder offers auto-renewable subscriptions (e.g., Weekly and Monthly) that grant in-app search credits. Payment is charged to your Apple account at confirmation of purchase. Subscriptions automatically renew at the then-current price unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your Apple account settings; deleting the App does not cancel a subscription. Credits are consumed per search and may expire at the end of a billing period. Purchases are final except as required by law or Apple's policies.
The App relies on third parties, including FaceCheck.ID (facial-similarity search), Apple (payments), RevenueCat (subscription management), Supabase (hosting), and analytics providers. Your use of search features is also subject to the third-party provider's terms and privacy practices. We are not responsible for third-party content, websites, or practices.
You accept full legal responsibility for your use of the App and any consequences of it. Any legal consequences of unlawful use or non-compliance are borne solely by you, without recourse to Facefinder.
To the maximum extent permitted by law, you irrevocably release and discharge Facefinder, its operators, affiliates, and third-party providers from any and all claims, liabilities, damages, losses, and proceedings, whether known or unknown, arising from or relating to the content, data, results, or services provided by or through the App.
THE APP IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY RESULTS OR CONTENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACEFINDER AND ITS PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR ANY ACTION YOU TAKE BASED ON RESULTS OR FOR YOUR INTERACTIONS WITH ANY PERSON IDENTIFIED THROUGH THE APP.
You agree to defend, indemnify, and hold harmless Facefinder and its affiliates, officers, and agents from any claim or demand, including reasonable attorneys' fees, arising from your use or misuse of the App or results, your breach of these Terms, or your violation of any law or any third party's rights.
These Terms remain in effect while you use the App. We may suspend or terminate your access at any time, with or without notice, for any reason, including breach of these Terms or applicable law.
We may change the App or these Terms at any time. Material changes will be indicated by updating the "Last updated" date; your continued use after changes constitutes acceptance. We may modify, suspend, or discontinue the App without liability.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Except where prohibited, any dispute will be resolved by binding individual arbitration on a non-class basis; you and Facefinder waive any right to a jury trial or to participate in a class action. Claims for injunctive relief or intellectual-property protection may be brought in court.
Our Privacy Policy is incorporated into these Terms by reference. By using the App you agree to it.
